1. Acceptance

By accessing aiko-ai.net or using the Aiko AI companion chat, you agree to these Terms of Service. If you do not accept them, do not use the service.

2. Definitions

“Service” means the Aiko AI website and companion chat. “Companion” means a fictional character offered within the Service. “Content” means text, images and other material available through or submitted to the Service.

3. Eligibility

You must be at least 18 years old and legally able to enter into a binding agreement. By using Aiko AI you confirm that both statements are true.

4. Account creation

You are responsible for the accuracy of the details you provide and for keeping your password confidential. Notify us promptly if you suspect unauthorised use of your account.

5. One person per account

Accounts are personal. You may not share, sell, rent or transfer your Aiko AI account to anyone else.

6. Nature of the service

Aiko AI provides entertainment and companionship through fictional characters. Nothing generated by a companion is a statement of fact, professional advice or a promise on our behalf.

7. Not professional advice

Companion responses must never be treated as medical, psychological, legal, financial or safety advice. Always consult a qualified professional for such matters.

8. Emergencies

Aiko AI is not an emergency or crisis service. If you or somebody else is in danger, contact your local emergency number or a recognised crisis helpline immediately.

9. Fictional characters

Every companion is invented. Names, ages, biographies and images are creative material and are not representations of real people, living or deceased.

10. Generated content

Responses are produced automatically and may contain inaccuracies or statements you disagree with. You use them at your own discretion and risk.

11. Acceptable use

You agree not to use Aiko AI for anything unlawful, abusive, hateful, deceptive or harmful to others, and not to attempt to produce prohibited material through the Service.

12. Strictly prohibited content

Any attempt to generate sexual content involving minors, real identifiable individuals without consent, or content promoting violence or exploitation results in immediate and permanent termination.

13. No scraping or automation

You may not use bots, crawlers, scripts or other automated means to access, copy or overload the Service without our written permission.

14. Security testing

Probing, scanning, penetrating or otherwise testing the security of our systems without prior written authorisation is prohibited.

15. Reverse engineering

You may not decompile, disassemble or otherwise attempt to derive the underlying components or models behind Aiko AI, nor resell access to them.

16. Your submissions

You keep ownership of what you write. You grant Aiko AI a limited licence to store and process your messages solely to operate the Service for you.

17. Our intellectual property

The Aiko AI name, branding, site design, written content and companion artwork are protected. You may not reproduce them commercially without written permission.

18. Free and paid access

Core access to Aiko AI is free. Optional paid features may be offered, and their price, billing period and scope are shown before you confirm any purchase.

19. Billing and renewal

Where a subscription renews automatically, we state the renewal terms at checkout. You can cancel future renewals at any time from your account settings.

20. Refunds

Refund requests are considered on their merits and in line with the consumer law that applies where you live. Contact support with your order details to start a request.

21. Third-party payments

Payments are processed by external providers whose own terms apply to the transaction. We are not responsible for their systems or decisions.

22. Availability

We aim to keep Aiko AI available continuously, but the Service may be interrupted for maintenance, updates or reasons beyond our control. No specific uptime is guaranteed.

23. Changes to the service

We may add, alter or withdraw features, companions or content at any time. Where a change is significant we will give reasonable notice on the site.

24. Suspension and termination

We may suspend or close an account that breaches these Terms, harms other users or exposes us to legal risk. Serious breaches may lead to termination without notice.

25. Ending your account

You may stop using Aiko AI and delete your account at any time. Deletion removes your access and begins the data removal described in our Privacy Policy.

26. Disclaimer of warranties

The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, to the fullest extent permitted by law.

27. Limitation of liability

To the maximum extent the law allows, Aiko AI is not liable for indirect, incidental or consequential losses, including lost profits, lost data or emotional distress arising from use of the Service.

28. Liability cap

Where liability cannot be excluded, our total liability is limited to the amount you paid to Aiko AI in the twelve months before the event giving rise to the claim.

29. Indemnity

You agree to hold Aiko AI harmless against claims, damages and reasonable costs arising from your misuse of the Service or your breach of these Terms.

30. External links

Links to other websites are provided for convenience. We do not control those sites and accept no responsibility for their content, products or practices.

31. Privacy

Your use of Aiko AI is also governed by our Privacy Policy, which forms part of these Terms and explains how your information is handled.

32. Governing law and disputes

These Terms are governed by the laws applicable at our place of establishment. Please contact us first so that most disputes can be resolved informally and quickly.

33. Severability and entire agreement

If any provision is found unenforceable, the remainder stays in force. Together with the Privacy Policy, these Terms are the entire agreement between you and Aiko AI.

34. Updates to these terms

We may revise these Terms as the Service develops. Continued use after the effective date shown above means you accept the revised version.
